Welcome to Haven. By accessing our website, purchasing our products, or using the Haven device, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our website or products. Please read them carefully.

1. Overview

Haven sells physical USB devices pre-loaded with open-source AI software and models. Our website at gethavenai.com is operated by Haven. Throughout these Terms, "we," "us," and "our" refer to Haven. "You" and "your" refer to you as a visitor to our website, purchaser of our products, or user of the Haven device.

2. Eligibility

You must be at least 18 years of age to purchase or use Haven. By placing an order or using the product, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are purchasing Haven on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Products

Haven is a USB drive containing pre-installed, open-source AI models and software that run locally on your computer. Key product characteristics:

• The device operates 100% offline; no internet connection is required
• AI models are open-source and run locally on your hardware
• The physical USB hardware is a genuine Corsair® Survivor Stealth drive
• Haven is not affiliated with, endorsed by, or sponsored by Corsair Memory, Inc.
• System requirements and compatibility information are provided on our website; you are responsible for verifying that your computer meets these requirements before purchasing

4. Pre-Orders

When you place a pre-order:

• Your payment method will be charged at the time of order
• Estimated ship dates are provided in good faith but are not guaranteed
• If we are unable to fulfill your order within a reasonable timeframe, we will notify you and offer a full refund
• You may cancel your pre-order at any time before shipment for a full refund by emailing support@gethavenai.com

5. Pricing & Payment

All prices are listed in US dollars and do not include applicable taxes or shipping costs, which will be calculated at checkout. We reserve the right to change prices at any time without prior notice. Pricing at the time of your order will be honored for that transaction. We are not responsible for pricing errors due to website malfunctions; if an error occurs, we will notify you and offer the option to proceed at the correct price or receive a full refund.

7. Acceptable Use

You agree not to use Haven to:

• Generate content that is illegal under applicable law
• Produce child sexual abuse material (CSAM) or any content that sexually exploits minors
• Create content intended to facilitate violence, terrorism, or physical harm against any person or group
• Generate content that facilitates harassment, stalking, or threats against specific individuals
• Produce fraudulent or deceptive content intended to defraud others or impersonate real individuals
• Create malware, phishing materials, or other content designed to compromise computer systems
• Violate any applicable local, state, national, or international law or regulation

Because Haven operates entirely offline on your device, we have no technical ability to monitor, control, or restrict your usage. You are solely responsible for how you use the product and for ensuring your use complies with all applicable laws. Violation of these acceptable use terms voids any warranty or support obligations on our part.

8. User-Generated Content & Output Ownership

Any content you generate using Haven belongs to you, subject to the open-source license terms governing the underlying AI models. We claim no ownership of your inputs or outputs. You are solely responsible for any content you create using Haven and for ensuring that such content complies with applicable laws and third-party rights.

9. Open-Source Software & Licensing

License Grant: By purchasing Haven, you receive a personal, non-exclusive, non-transferable license to use the Haven software bundle (including the launcher, installer, and configuration files created by Haven) on your own computer(s) for personal or internal business use. This license is tied to your purchase and does not grant you the right to resell, sublicense, or commercially distribute the Haven software bundle as a product.

Open-Source AI Models: Haven includes AI models built on Meta's Llama architecture and distributed under the Meta Llama Community License Agreement. The Dolphin fine-tuned models are distributed under their applicable open-source licenses. By purchasing and using Haven, you agree to comply with all applicable open-source license terms. Your rights to use, modify, and distribute the AI models themselves are governed solely by their respective open-source licenses — not by these Terms.

Meta Llama Commercial Use: The Meta Llama Community License Agreement includes usage thresholds for commercial use. If your product or service using Llama models exceeds 700 million monthly active users, you must request a separate license directly from Meta. Please review the full Meta Llama license for details.

Distribution of AI Models: You may redistribute the open-source AI models included on Haven only in accordance with their respective open-source licenses. However, you may not redistribute, copy, or resell the Haven software bundle (including any proprietary launcher, installer, scripts, documentation, or configuration created by Haven) separately or as part of another product without our prior written consent.

No Resale of Haven: You may not purchase Haven devices for the purpose of reselling the pre-loaded software bundle as a competing product or service. Resale of the physical Haven USB device itself (as a complete, unmodified unit) is permitted.

The open-source software included on Haven is provided by third-party developers. We do not warrant or guarantee the performance, safety, or suitability of any third-party software. Your use of such software is governed by the applicable open-source license, not these Terms.

10. Intellectual Property

The Haven brand, logo, website design, marketing content, and original software are the exclusive property of Haven and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary materials without our written consent. The AI models included on the device are open-source and subject to their respective licenses. Corsair® and Corsair Survivor® are registered trademarks of Corsair Memory, Inc.

11. Software Updates

We may provide software and model updates at no additional cost for as long as we actively maintain the product. Updates are optional and delivered via email with instructions. We reserve the right to discontinue update support at any time without notice. Your existing Haven device will continue to function as-is regardless of whether updates are provided. We are not obligated to provide updates, bug fixes, or new features.

12. Warranty & Disclaimer

Limited Hardware Warranty: We warrant that the Haven USB device will be free from defects in materials and workmanship for a period of 30 days from the date of delivery. This warranty covers manufacturing defects only and does not cover damage caused by misuse, accidents, unauthorized modifications, or normal wear and tear. The Corsair hardware may carry its own separate manufacturer warranty — please refer to Corsair's warranty terms for details.

Software Disclaimer: All software and AI models included on the Haven device are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• In no event shall Haven, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Haven product
• We are not liable for any damages arising from your use of or reliance on AI-generated content, including but not limited to decisions related to health, finances, legal matters, or emergency situations
• Our total aggregate liability for all claims related to our products or services shall not exceed the amount you actually paid for the Haven product giving rise to the claim
• We are not responsible for any data loss, hardware damage, or software conflicts that may arise from using the Haven USB device on your computer
• We are not liable for any third-party claims arising from content you generate using Haven

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Haven, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Haven product; (b) any content you generate using Haven; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

15. Returns & Refunds

We offer a 30-day money-back guarantee from the date of delivery. Please refer to our Refund Policy for full details on returns, exchanges, refund processing, and return shipping.

16. Privacy

Your privacy is important to us. Please review our Privacy Policy, which describes how we collect, use, and protect your personal information when you visit our website and make purchases. The Haven device itself operates entirely offline and does not collect, transmit, or store any data on our servers.

17. Export Compliance

The Haven product may be subject to U.S. export control laws and regulations. You agree that you will not export, re-export, or transfer the Haven product or any included software to any country, entity, or person prohibited by applicable export laws, including U.S. sanctions programs. You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. trade sanctions.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware and the applicable federal laws of the United States, without regard to conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

19. Dispute Resolution

Informal Resolution: Before filing any formal claim, you agree to first contact us at support@gethavenai.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve the dispute informally, you and Haven agree to resolve any remaining dispute through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware or, at your election, via telephone or video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: You and Haven agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then this entire arbitration provision shall be null and void, and disputes shall be resolved in court.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Opt-Out Right: You may opt out of this arbitration provision by sending written notice to support@gethavenai.com within 30 days of your first purchase of a Haven product. If you opt out, disputes will be resolved in the courts specified in Section 18.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Haven regarding your use of our website and products. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Haven.

23. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

24. Force Majeure

Haven shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, supply chain disruptions, government actions, or failures of third-party services.

25. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify you via the email address associated with your order. Changes become effective upon posting to this page. Your continued use of our website or products after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our website.
